Terms of Service

1. Acceptance of Terms

By accessing or using HumMatch (the "Service"), operated at hummatch.me, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of Service

HumMatch is a voice-matching service that analyzes your vocal range through microphone input and matches it to songs in our catalog. The Service is provided on an "as-is" and "as-available" basis. We do not guarantee that song matches will be perfectly accurate or that the Service will be uninterrupted or error-free.

3. Free Tier

HumMatch offers a free tier with limited functionality. Free users may perform a limited number of hum tests and receive basic song matches. Certain features, including unlimited hum tests, expanded song catalogs, playlist saving, SquadMatch, and priority support, are reserved for Premium subscribers. We reserve the right to modify free tier limitations at any time.

4. Premium Subscription

Billing. Premium subscriptions are billed on a recurring basis (monthly or annually, as selected at checkout). Payment is processed securely by Stripe. By subscribing, you authorize Stripe to charge your payment method on each billing cycle.

Pricing. Subscription prices are displayed at checkout. We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing cycle.

Cancellation. You may cancel your Premium subscription at any time from your dashboard or by contacting us. Upon cancellation, you will retain Premium access until the end of your current billing period. No prorated refunds are issued for partial billing periods.

Refunds. We generally do not offer refunds for subscription payments. If you believe you were charged in error, contact us within 14 days of the charge and we will review your case.

5. User Accounts

To access certain features, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your authentication token and for all activity under your account. Notify us immediately if you suspect unauthorized access.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Scrape, crawl, or use automated tools to extract data from the Service
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or entity
• Upload malicious content or attempt to exploit vulnerabilities
• Resell, redistribute, or commercially exploit the Service without authorization

Violation of these terms may result in immediate account termination without notice.

7. Intellectual Property

All content, features, and functionality of the Service—including but not limited to the song matching algorithm, user interface design, graphics, logos, and text—are owned by HumMatch and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written consent.

Song titles, artist names, and related metadata displayed in the Service are provided for informational purposes. All trademarks belong to their respective owners.

8. Voice Data & Microphone Access

By using the hum test, you grant HumMatch permission to access your device microphone for the sole purpose of detecting your vocal pitch and range. Audio is processed locally in your browser. We do not record, store, or transmit raw audio. See our Privacy Policy for full details on data handling.

9. Limitation of Liability

To the maximum extent permitted by law, HumMatch and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to HumMatch in the 12 months preceding the claim, or $50, whichever is greater.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that song matches will be accurate, that the Service will meet your requirements, or that it will operate without interruption.

11. Indemnification

You agree to indemnify and hold harmless HumMatch and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
